The Supreme Court on Friday announced it would hear former President Donald Trump’s appeal of a Colorado Supreme Court decision to disqualify him from the ballot under the 14th Amendment.

Oral arguments will take place on Feb. 8, the Washington Post reported.

In late December, the Colorado Supreme Court determined that Trump was ineligible for the presidency under the “insurrection” provision of the 14th Amendment due to his role in the Jan. 6, 2021, Capitol riot. Trump’s attorneys swiftly vowed to appeal the decision and formally requested the Supreme Court’s intervention on Wednesday.

The Colorado Republican Party independently appealed the ruling.

Outside of Colorado, Maine Secretary of State Shenna Bellows issued her own determination that Trump was ineligible over his role in the Jan. 6 disturbance, but paused his removal from the ballot to allow an appeal. Trump has since challenged Bellows’s decision in state court.

  1. Well, well, well. I was just about to suggest Colorado volunteer to secede from the US for denying candidate access to its ballot. Voters have as many rights in this country, presumably, as candidates, and voters should have the right to choose from among candidates, no matter what the legal mucky mucks say.

    Remember that the US Supreme Court is composed of an unelected crew of arbitors. How many judges are elected in this multi-layered system of so-called representative government?

    • Katherine, the US is the only democratic republic I know of that hasn’t rewritten its constitution once in nearly 250 years. All the other global democracies rewrite their to accommodate their changing society. Our constitution still says that Black slaves are only 3/5 of a person.

      • Good point. It looks as though the US is collapsing from its own archaic weight. That’s maybe why individual states have secession movements in play. Texas, Vermont, and others seem fed up. Colorado . . . ? The Navajo Nation?

  2. In my opinion, Trump did not violate the “insurrection” division of the 14th Amendment. A court of law has not found him guilty of that and so his name should not have been removed from any state’s ballot. This is just politics, as usual. Trump’s name will be on the ballot in every state. Joe Biden is not going to serve a 2nd term, whether it is from him dropping dead, bowing out or losing to Trump, is anyone’s guess.
